A land easement is an encumbrance imposed on one real property, called the servient estate, for the benefit of another real property, called the dominant estate, which belongs to another owner. A land easement arises by operation of law or by legal transaction. It can be acquired by prescription through a 10-year exercise.
We have considerable experience in providing legal services to clients working in the real estate and construction sectors, as these areas of activity are most often faced with the need to establish easement rights. Our experience includes advising on existing and statutory easements under the energy laws, as well as establishing new easements under the current Energy Law or based on executed contracts, orders, approved development plans, etc.
Our legal knowledge and substantial practice in the application of the acts regulating easement rights - the Energy Act, the Spatial Planning Act, the Water Act, the Property Act and all relevant by-laws - places us at the forefront of legal advice on energy and land easements.
